User Agreement

This English translation is provided for convenience only. In case of any discrepancy between the Russian original and this English translation, the Russian version shall prevail.

1. General Provisions

1.1. LLC “SYROVARNYA” (TIN 7730242132, registered address: 115114, Moscow, Danilovsky Municipal District, Letnikovskaya St., 5, room 1/2) offers the User to use the SYROVARNYA Service under the terms set forth in this Agreement.

1.2.This Agreement is addressed to all Internet users who have accessed the Service and constitutes a public offer.

1.3. The use of the SYROVARNYA Service is governed by this Agreement and the Privacy Policy (https://www.syrovarnya.com/privacy_policy). The Agreement may be amended without any special notice. The new version of the Agreement comes into effect from the moment it is posted on the Service. The current version of the Agreement is always available at: https://www.syrovarnya.com/agreement.

1.4. By starting to use the Service or completing the registration procedure, the User is deemed to have fully accepted the terms of this Agreement, without any reservations or exceptions. If the User disagrees with any provision of the Agreement, they are not entitled to use the Service. In case of any amendments to the Agreement under clause 1.3 with which the User does not agree, they must cease using the Service.

2. Definitions

Organization - LLC «SYROVARNYA» (TIN 7730242132, registered address: 115114, Moscow, Danilovsky Municipal District, Letnikovskaya St., 5, room 1/2).

User – any individual aged 18 (eighteen) years or older registered in the Service.

Registration – actions performed as specified in the User Agreement of the Service used.

Service – the website located at https://www.syrovarnya.com, intended for posting information about the Organization, placing Orders with Partners by Users, and the Organization’s mobile application – software installed (downloaded) on a mobile device (smartphone, tablet, etc.) on iOS and Android platforms, consisting of data and commands for User registration and used as a tool for placing information, placing Orders with Partners, and other functions.

Personal Account – a protected part of the platform created after Registration in the Service, containing information about the User and the history of Orders.

Violation – User actions associated with abuse of the rights provided by the Service.

Partner – a legal entity or individual entrepreneur engaged in public catering services and/or delivery.

Order – a request placed by the User via the Service for public catering services via delivery or self-pickup.

Profile – the User’s account in the Application, as well as associated accounts.

Promo Code – a code granting the User the right to receive a discount on certain services in an Order.

3. Subject Matter

3.1. The Organization grants the User the right to use the Service, and the User undertakes to use the Service solely in accordance with the terms of this Agreement.

3.2. When using the Service to place an Order, obligations for the execution of the Order and liability for improper fulfillment lie directly with the Partner.

3.3. The territory of the Service usage is the Russian Federation.

3.4. The term of use of the Service is during the validity of this Agreement.

3.5. Services provided by the Organization under this Agreement are gratuitous and for informational purposes only, and therefore the Organization does not incur any obligations towards the User.

3.6. The Organization is not an authorized body under the Russian Law No. 2300-1 of 07.02.1992 “On Protection of Consumer Rights” and does not consider or satisfy User claims regarding the provision of services of inadequate quality.

3.7. The Organization is not responsible for the content and/or relevance of information provided by the Partner, including prices, delivery, service timeframes, or availability of certain products (stop-list) at the moment with this Partner.

4. Rules of Service Use

4.1. The User is solely responsible to third parties for their actions using the Service, including any actions that violate the rights or lawful interests of third parties, and for compliance with applicable law when using the Service.

4.2. By using the Service, the User consents to receiving informational messages from the Organization and Partners.

4.3. The User shall not:

• Reproduce, duplicate, copy, sell, resell, or use for commercial purposes any part of the Service (including content available to the User via the Service);
• Otherwise violate applicable law, including international law.

4.4. Only individuals aged 18 (eighteen) or older may use the Service. By using the Service, the User confirms that they are at least 18 years old. The Organization reserves the right to request age verification at any time.

4.5. During Registration, the User must provide complete and accurate information: mobile phone number (registered in the Russian Federation), full name, email address. This information can be modified in the Personal Account (Profile) if necessary. All actions performed through the User’s Personal Account are deemed actions of the User.

4.6. The Organization provides the Service “as is” and is not responsible for issues that may arise during updates, maintenance, or operation of the Service (including compatibility problems with other software, packages, drivers, etc.). The User acknowledges full responsibility for any negative consequences caused by incompatibility of the Service with other software installed on the User’s device.

4.7. The User is solely responsible to third parties for their actions on the Service, including violations of third-party rights or interests, and compliance with Russian Federation law while using the Service.

4.8. By paying for an Order, the User enters into a contract with the Partner and establishes direct contractual relations. Placing an Order via the Service indicates the User’s acceptance of all essential delivery terms set by the Partner and published on the Service, as well as the terms of this Agreement.

4.9. Essential terms of the User’s contract with the Partner are specified in the description of preparation/implementation, cost, and delivery conditions.

4.10. Cancellation of an Order by the User is possible only before receiving confirmation of acceptance of the Order and if the Partner has not begun preparation. If the Order is canceled after acceptance by the Partner, the cost is non-refundable and retained by the Partner to cover expenses.

5. Payment for Orders

5.1. Payment for Orders is made by the User:

• In cash or cashless via POS-terminal to the Partner if delivery is performed directly by the Partner or via self-pickup;
• Cashless by bank card.

5.2. The User selects the payment method in the Service interface.

If the User selects bank card payment, after completing the Order, the User will be redirected to a secure page of the Bank-Partner’s payment system to enter card details and CVV2 (CVC2). If supported, 3D Secure verification may be required.

5.3. The Bank-Partner protects and processes the User’s card data according to PCI DSS and PA DSS standards. Data is transmitted over secure banking networks. The Bank-Partner does not disclose card information to the Organization or third parties.

5.4. Internet payment security is guaranteed by the Bank-Partner. All card operations comply with VISA, MasterCard, MIR, JCB, and other payment systems.

5.5. If the User refuses the Order, or the Partner violates conditions, including unilateral refusal or delivery delay, the User must notify the Organization within 24 hours by email cs@syrovarnya.com or phone +7 (800) 707-50-76, provide payment confirmation, and request a refund (full or partial).

5.6. Refunds for payments via the Application are made by the Partner within 5-30 business days.

5.7. After 24 hours, if no notice is received, the Order is deemed fulfilled, and payments are non-refundable.

5.8. Refunds for card payments are made only to the original card.

5.9. To prevent fraud, card payments may be verified. Users must provide documents to confirm lawful use if requested.

6. Intellectual Property

6.1. All objects available via the Service, including design elements, text, graphics, illustrations, video, and any content, are exclusive property of the Organization and/or its Partners.

6.2. Use of content or other Service elements is only within the Service functionality. Any reproduction, copying, distribution, or display requires prior authorization.

7. Third-Party Sites and Content

7.1. The Service may contain links to third-party websites. The Organization does not verify the accuracy, completeness, or legality of third-party content. The Organization is not responsible for information, materials, opinions, or advertisements on such sites, nor for their availability or consequences of use by the User.

7.2. Any link to a third-party site, product, or service does not constitute approval or recommendation by the Organization or Partner.

8. Miscellaneous

8.1. This Agreement is governed and interpreted in accordance with Russian Federation law. Any unresolved matters shall be settled according to Russian law. All disputes arising under this Agreement are subject to resolution in accordance with applicable Russian law. Unless explicitly stated otherwise, “law” refers to Russian law and the law of the User’s location.

8.2. For services provided free of charge under this Agreement, consumer protection laws of the Russian Federation do not apply to relations between the User and the Organization.

8.3. If any provision of this Agreement is deemed invalid or unenforceable, it does not affect the validity of remaining provisions.

8.4. Before using the Service, the User warrants that:

• They have provided truthful personal data belonging solely to them;
• They have all rights and authority necessary to use the Service.

8.5. The User and the Organization shall not disclose any confidential information about each other.

8.6. Confidentiality obligations last for the term of this Agreement and 5 (five) years after termination.
